LCS Działdowo Contract Settled
PKP Polskie Linie Kolejowe and Trakcja PRKiI S.A. have settled the LCS Działdowo contract. The most important part of the settlement is the conclusion of a settlement agreement resolving mutual claims.
Trakcja PRKiI S.A., acting as the leader of the Consortium of contractors modernising the 58 km section of the Warszawa – Gdynia line between Mława and Montowo, consisting of:
1. Trakcja PRKiI S.A.,
2. ZUE S.A.,
3. Przedsiębiorstwo Napraw i Utrzymania Infrastruktury Kolejowej w Krakowie Sp.o.o.,
4. Ing. Jiří Hanák, insolvenční správce (insolvency administrator) EIFFAGE CONSTRUCTION CESKA REPUBLIKA, s.r.o.,
5. Zakład Robót Komunikacyjnych DOM w Poznaniu Sp. z o.o.
conducted negotiations and concluded a Pre-Litigation Settlement Agreement with the Contracting Authority, under which the Contracting Authority undertook to pay the Consortium PLN 15,740,228.58.
In addition, independently of the Settlement Agreement, the Contracting Authority undertook to pay the Consortium PLN 7,259,771.42 as coverage of the costs of performing the Contract over an extended period. Under the Final Settlement of the Contract, in connection with remuneration for works performed in previous periods during the term of the Contract, the Contract Engineer recognised the amount of PLN 17,997,919.06 gross, which the Contracting Authority undertook to pay to the Consortium.
“From the very beginning of the dispute we jointly sought to reach an understanding, and the settlement signed is the optimal solution for each of the parties. By using the available conciliation institutions, we avoided lengthy and costly court proceedings. At the same time, we safeguarded the Company’s interests connected with this contract.” – says Roman Przybył, President of the Management Board of Trakcja PRKiI S.A.
“Under the court settlement, PKP Polskie Linie Kolejowe S.A. recognised the Contractors’ costs incurred during the extended period needed to perform the contract. We take the view that the way the negotiations were conducted, as well as the agreement reached, are of a precedent-setting nature and may be a model solution for similar cases arising between a contracting authority and a contractor.” – adds Roman Przybył.
