5/2023 – Information on the Amendment to the Contract by Trakcja S.A. – Adjustment of Compensation

The Management Board of Trakcja S.A. (the “Company”, “Issuer”) informs that, in reference to current report No. 57/2019, it has today received information about an amendment (the “Amendment”) signed on February 7, 2023, by both the Issuer and PKP Polskie Linie Kolejowe S.A. (the “Ordering Party”) to the contract dated October 10, 2019, titled “Execution of design and construction works within the project titled: ‘Revitalization of railway lines No. 694/157/190/191 Bronów–Bieniowiec–Skoczów–Goleszów–Cieszyn/Wisła/Głębce’ Partial Order A: Design and execution of construction works on the section from Podg Bronów – Wisła Głębce” (the “Contract”).

Due to the war in Ukraine and the circumstances it has caused, the adjustment limit for the compensation due to the Contractor under the Contract has been increased from 5% to 10% of the Contract’s value, resulting in the maximum total adjustment amount not exceeding PLN 34.9 million net.

The Amendment does not alter any other material terms of the Contract.
