Press Release by Trakcja S.A. Regarding the Groundless and Ineffective Withdrawal by the General Directorate for National Roads and Motorways (GDDKiA) from the Contract for the Expansion of National Road No. 22 Czarlin – Knybawa

On 17 August 2020, GDDKiA delivered to Trakcja S.A. a statement regarding GDDKiA’s withdrawal from the contract for the expansion of national road No. 22 between Czarlin and Knybawa.

Trakcja S.A. announces  that it does not agree with the allegations made in that statement.  The Company has furthermore carried out a legal analysis of the facts and the legal basis of GDDKiA’s statement and takes the position that GDDKiA’s statement on withdrawal from the contract is ineffective.

The reason for the shifts in the work schedule is  above all the impossibility of performing the contract and achieving the assumed result due to GDDKiA’s failure to provide correct and complete documentation, which is a fundamental obligation of the Contracting Authority that announces a tender for a public procurement for construction works.

The documentation provided to the Contractor was not only incomplete, but also did not reflect the actual condition of the structures undergoing rehabilitation, including key bridge structures. Bearing in mind concern for the safety of road users, Trakcja S.A. could not agree to carry out the works based on the Contracting Authority’s documentation.

The Dispute Adjudication Board (Komisja Rozjemcza), appointed in accordance with the contract and independent of the Contracting Authority and the Contractor,  found that, among other things, due to the above facts, the contract completion date should be formally changed, and Trakcja S.A. is entitled to additional remuneration for the additional works necessary to perform the contract. GDDKiA, however, did not implement the decision of the Dispute Adjudication Board, but instead charged the Contractor contractual penalties.  

Bearing in mind the quality of the works and concern for the safety of users,  but also not exposing the Company to losses related to the lack of cooperation on the part of GDDKiA, in the coming days Trakcja S.A. will take further practical and legal steps in this matter.
